Why Is a Collective Petition More Effective?

When more than one unit owner shares the same request on a matter, submitting a single joint (collective) signed petition is more effective than everyone submitting a separate petition. A collective petition shows that the request is not only the will of one person but the common will of a significant portion of the owners; this makes management take the matter seriously and facilitates, if necessary, the call for an extraordinary meeting.

What Is It Used For?

  • Requesting an extraordinary general assembly meeting
  • Requesting the resolution of a common problem (repair, security, accounts)
  • Requesting that management perform a specific action
  • Bringing matters such as manager change on the agenda

On certain matters (for example, the call for an extraordinary meeting), the law requires the request of a specific number of owners; therefore the number of signatures is important.

Filling Guide

Each signer's name-surname and unit number must be complete; incomplete information weakens the petition. If you are requesting an extraordinary meeting, pay attention to reaching the number/ratio of owners required by law. Deliver the petition against signature and keep a copy.

As a rule there is no minimum; even two owners may submit a joint petition. For specific demands such as convening an extraordinary general meeting, however, the quorum required by the statute applies. The weight of the request increases with the number of signatures.

For demands requiring a resolution, the signatory must be an owner; a tenant's signature supports the request but does not count towards votes or quorum. Each signature should be accompanied by the name and unit number. If signing by proxy, the written authority must be attached.

Prepare two copies: one is handed to the management and the other is signed as proof of receipt. If the manager refuses to sign, send the petition by registered mail or through a notary. The proof of delivery is the key evidence at later stages.

Because the manager is liable to the owners as an agent, they must consider requests and provide information. The statute sets no fixed period for a written reply; fifteen days is treated as reasonable in practice. If there is no response, the matter can be taken to the general assembly or to court.

Put the request on the general assembly agenda and attempt a resolution; if necessary, request an extraordinary meeting. If that also fails, judicial intervention may be sought from the Civil Court of Peace under Article 33 of the Condominium Law. The petition and proof of delivery are filed with the case.
