Management Is a Mandate
Under the Condominium Ownership Law (KMK), being an apartment manager is a mandate relationship; the manager has the right to leave the post. However, if the manager leaves the duty "without just cause" at an inconvenient time, they may be held liable for any resulting damages. Resignation is therefore not merely saying "I am leaving"; it is a process that must be completed with a written petition, submission of accounts (operating report) and a proper handover.
Elements of the Resignation Letter
- Addressee: Address to "the Board of Unit Owners" (and to the Auditor / audit board if any)
- Identity information: The manager's name-surname, unit number, and start date of duty
- Resignation statement and date: As of which date the duty is being left
- Reason: Not required but a short reason as a courtesy
- Handover commitment: A list of which documents and assets will be handed over
- Operating report / accounts: That the period's income-expense accounts will be submitted
- Extraordinary general assembly call: A request for a meeting to elect a new manager

Common Mistakes
- Only saying "I resign": Responsibility does not fully end without submission of accounts and handover.
- Not submitting the operating report: Discharge happens through review of the period accounts.
- Not calling an extraordinary general assembly: The building must not remain unmanaged; a meeting is required for a new election.
- Leaving at an inappropriate time: Without just cause, liability for damages may arise.
