What Is an Auditor Report?

Under Article 41 of the Condominium Ownership Law (KMK), the board of unit owners elects an auditor or audit board to inspect the management's accounts. The auditor examines the income-expense records, bank statements and sample invoices throughout the period and submits the result to the assembly as a report. This report is the basis of the manager's discharge process.

What Does the Auditor Examine?

  • Income records (dues collections, other income)
  • Expense records and their conformity with documents
  • Reconciliation of the bank statement with the book balance
  • Debtor list and follow-up status
  • Whether decisions have been implemented

Filling Guide

Write the figures by verifying them with documents and the bank statement. The most critical part is the cash-bank reconciliation: the book balance and the actual bank balance must match. In the opinion section, if there are deficiencies, specify them concretely; the discharge decision is taken by the assembly based on this report.

The law does not require an auditor; the general assembly may appoint one auditor or a board of three if it wishes. Even without an auditor, the assembly retains the power to supervise the manager's conduct. If the management plan provides for an auditor, that provision applies.

Under Article 41 of the Condominium Law, where the management plan sets no period the accounts are audited every three months. Where a valid reason arises, an audit may be carried out at any time. The request for an audit should be submitted to the management in writing.

The auditor may examine the operating ledger, income and expenditure documents, bank movements, contracts, collection receipts and the cash balance. The manager is obliged to make these available. Any refusal to produce documents should be expressly noted in the report.

The report is entered, with a date, in a book with sequentially numbered pages each stamped by a notary, and signed by the auditors. A copy is submitted to the general assembly and discussed on the agenda. An oral presentation alone is not sufficient.

The report is discussed at the general assembly, which may withhold discharge, demand repayment of the missing amount or resolve to remove the manager. Where undocumented spending or personal use is identified, civil and criminal proceedings may be started. The report is key evidence in those proceedings.
