When Is a Criminal Complaint Made?

The apartment manager is obliged to use the dues and advances collected from unit owners only for the building's expenses. If the manager uses this money outside its purpose, spends it on personal needs or takes it into their own custody, this situation may constitute a crime such as "abuse of trust due to service". If there is such a concrete suspicion, the unit owner(s) may file a criminal complaint with the Chief Public Prosecutor's Office.

Important Distinction: Accounting Dispute or Crime?

Not every accounting dispute is a crime. The manager's failure to properly submit accounts is primarily a legal matter and is resolved by a notice and judicial intervention. A criminal complaint comes on the agenda when there is concrete evidence and suspicion that the money has been misused. A groundless criminal complaint may create liability for the applicant; therefore evidence is important.

No. Embezzlement can only be committed by public officials, and an apartment manager is not one. A manager who uses collected dues for other purposes commits abuse of trust under Article 155 of the Turkish Penal Code. Although people commonly say embezzlement, the petition should use the correct legal characterisation.

The complaint is filed with the Chief Public Prosecutor's Office where the offence was committed. It can be submitted in person or electronically through the national judiciary portal. No court fee is charged.

The basic form of abuse of trust requires a complaint within six months of learning of the act and the perpetrator. For the aggravated form, concerning money entrusted to the manager by virtue of their authority, the investigation proceeds without a complaint. Where there is doubt, it is safer to apply without letting the period lapse.

Documented but contested expenditure is a civil dispute resolved before the civil courts. Transferring funds to a personal account, producing false documents or providing no records at all points to criminal conduct. Filing a complaint without concrete evidence creates a risk of being accused of false denunciation.

Attach the resolution appointing the manager, the operating budget, bank statements, collection receipts, the auditor's report and any correspondence requesting the accounts. If a document cannot be supplied, state in the petition who holds it. The prosecutor can be asked to obtain such documents.
