Why Should a Lift Fault Be Reported in Writing?
A lift is an installation that bears directly on personal safety. Reporting a fault verbally leads to later arguments about whether notice was given and makes it harder to establish liability if an accident occurs.
A written report documents the maintenance company's obligation, that the management was informed, and how long the fault lasted. These records are decisive in both insurance and court proceedings.
The Management's Duties Regarding Lifts
- Entering into a maintenance contract with an authorised company and ensuring regular servicing
- Arranging the annual periodic inspection and keeping the report
- Taking out of service any lift found unsafe at inspection
- Ensuring the emergency call system in the car is operational
- Keeping fault and maintenance records on file
A lift given a red label at periodic inspection must be taken out of service immediately. Continuing to allow its use despite the label creates serious liability.

Filling Guide
Describe the fault concretely. A description such as "the car stops 15 cm below floor level" is far more useful than "the lift is broken", both for a faster response and in any dispute.
State when and by what channel the report was made; if by telephone, note the time and the person spoken to.
If anyone was trapped, always record it. This is the strongest evidence when establishing liability for recurring faults.
After the Fault
Once the company attends, obtain the service sheet showing the work done and keep it on file. If the same fault recurs, these sheets form the basis for terminating the contract.
If the maintenance company fails in its obligations, send a notarial notice and, if necessary, terminate the contract and engage another company. Where the periodic inspection duty is neglected, an application can be made to the municipality.
Common Mistakes
- Verbal reporting: without a record, the company's delay cannot be proved.
- Allowing use of a red-labelled lift: creates serious liability.
- Not keeping service sheets: leaves no history for recurring faults.
- No warning notice: a lift taken out of service must always be marked.
- Skipping periodic inspection: the annual inspection is a legal obligation.
