First Step in Neighbour-Caused Damage

When water leaking from the upper floor, a burst installation or damage arising from the neighbour's fault occurs, the first step is to document the situation and to request the remedy of the damage in writing. Verbal requests are forgotten or denied; a written request both shows intent and, if necessary, becomes evidence in the insurance/lawsuit process.

Documentation First

Record the damage with photos and video, if possible add dates. Identify the source of the damage (which unit, which installation). If any, building/home insurance (home package insurance other than DASK) may come into play; therefore inform the insurance company as well. These documents will be useful both in agreeing with the neighbour and, if necessary, in court.

Filling Guide

Write the date, source and scope of the damage clearly; be sure to attach the photos. If the damage originates from the common installation, the addressee is the management; if from an individual unit, it is the relevant owner. If you have home insurance, also apply to the insurance in parallel. If no agreement is reached, the legal path can be pursued with the assessment documents.

If the damage originates from the upper unit's own plumbing, the owner of that unit is liable. If the leak comes from shared installations, the cost is shared among all owners in proportion to their land shares. Where the tenant is at fault, they may be liable together with the owner.

Record the damage with dated photographs and video, and draw up a signed inspection record with the management and the neighbour present. Obtain a survey and cost estimate before any repair. If the parties refuse to sign, an application for preservation of evidence can be made to the Civil Court of Peace.

Start with a written request, then a notarial notice. If that fails, bring a compensation action; disputes arising from condominium ownership are heard by the Civil Court of Peace. Preserving evidence before filing is decisive for proof.

Tort claims must be brought within two years of learning of the damage and the person responsible, and in any event within ten years of the act. Missing the deadline extinguishes the claim. Sending a notice does not suspend the period, so the matter should not be delayed.

If the home insurance policy covers water damage, the loss can be claimed from the insurer and must be reported promptly. After paying, the insurer may seek recourse against the party at fault. Compulsory earthquake insurance does not cover water damage.
