Why Is Instalment Important?
An owner who cannot pay accumulated dues at once, instead of remaining silent, both shows good faith and can prevent the enforcement/lawsuit process by proposing an instalment payment plan to management in writing. Management also guarantees the collection. This is a reasonable solution for both parties; however, management's acceptance and, if possible, assembly approval are required.
Elements of the Petition
- Addressee (management) and debtor owner information
- Amount and period of the debt
- Proposed payment plan (number, amount and dates of instalments)
- Statement of good faith and payment commitment

Filling Guide
Write the debt amount and the plan you propose clearly; a realistic plan increases the chance of acceptance. Management's acceptance of the plan is the security of the collection, but management may request assembly approval. If the plan is accepted, have it approved in writing and make the payments on time; otherwise the instalment may be terminated.
After the Request
If management accepts the plan, the payments are made according to the plan and the enforcement process does not operate. We covered the collection and delay topics in our late dues and FIFO article, collection methods in our collection methods article, and the enforcement process for unpaid debt in our enforcement proceedings article.
Common Mistakes
- Unrealistic plan: Do not propose a plan you cannot pay.
- Not getting written approval: Have the accepted plan approved in writing.
- Remaining silent: Ignoring the debt speeds up the enforcement process; communication is better.
