Why a Special Regulation?

When renting housing units to tourists on a daily/short-term basis became widespread, this activity was regulated by a special law. The aim is both to bring tourism activity under record and to protect the peace of apartment residents. This is because constantly changing guests affect the residential character and security of the building.

Permit Certificate Requirement

To rent housing units for tourism purposes, a permit certificate must be obtained from the competent authority. Renting for tourism purposes without a permit is subject to administrative fines. That is, renting a unit on a daily basis is not just posting a listing and receiving guests; it requires a formal permit process.

The Most Critical Condition: Consent of Unit Owners

For an apartment unit to be rented for tourism purposes, as a rule, the unanimous consent of all unit owners in the building is required. This is an extremely heavy condition: even if a single owner opposes, the unit cannot be rented on a daily basis. Consequences of Unauthorized Rental

Short-term rental made without a permit certificate or without the consent of unit owners is subject to serious sanctions, including administrative fines. Difference from Normal Rental

These rules apply only to short-term rentals for tourism purposes. Renting a unit with a long-term (normal) rental contract is not subject to this regime and does not require the unanimity of unit owners. It is important not to confuse the two types of rental.

  • Unauthorized rental: Short-term rental without permit and consent is subject to penalty.
  • Not knowing the consent requirement: Starting without knowing unanimity is required creates disputes.
  • Confusing with normal rental: Long-term rent is not subject to these rules.
