The Legal Foundation of Apartment Management

In Turkey, the fundamental law of apartment and complex living is Law No. 634 on Condominium Ownership (KMK). This law draws the framework for everything from dues to common areas, from manager powers to neighborly relations. In 2026 as well, the fundamental rules are based on this law; however, in practice, certain topics (electric vehicle charging, KVKK, mandatory mediation) have come to the forefront.

Prominent Current Topics

Topics especially on the agenda in apartment management in 2026:

  • Installation of electric vehicle charging units in parking lots and the majority requirement
  • Protection of resident data (KVKK) and digital management
  • Mandatory mediation in dues and neighborly disputes
  • Administrative fines for noise and environmental violations
  • Short-term (Airbnb-style) rental restrictions

We addressed each of these topics in separate articles; you can find the links in the relevant sections.

The Manager\'s Increasing Responsibility

Apartment management is now too technical a task to be conducted on a "volunteer" basis. The manager bears a wide range of responsibilities, from personnel social security and occupational safety processes, to elevator/fire maintenance, from protection of resident data to financial transparency. We covered these responsibilities in detail in our manager\'s powers article.

Administrative Fines

Noise, environmental violations, and failure to fulfill certain obligations may be subject to administrative fines. In violations that continue despite management\'s warning, the municipality and law enforcement units may intervene. We explained the scope of administrative penalties in our administrative fines article.

Digitalization Is Not a Choice but a Necessity

Increasing legal and financial obligations make record-keeping and transparency mandatory. Undocumented transactions cannot protect the manager. Recording income and expenses, collections, decisions, and notifications in a digital environment is critical for both legal compliance and trust. We covered digital transformation in our digital transformation article.

Common Mistakes

  • Not tracking legislation: A manager who does not know the current rules is at risk.
  • Not keeping documents: Undocumented management is open to both penalties and disputes.
  • Neglecting new topics: Topics such as EV charging and KVKK are now part of daily management.
