That is, unless a specific space belongs to a unit in the title deed (as an annex), it is under the common use of all owners. This means that the approach "I always park here, this is my space" has no legal basis in most cases.

Can Parking Spaces Be Allocated?

Allocation of specific spaces in the common parking lot to specific units is possible, but this is done by a decision of the board of unit owners. The board may establish a fair allocation system (numbered spaces, order, lottery, etc.). A single owner's unilateral claim on a space is not valid; the allocation must be based on a common decision. Against a resident who continuously violates parking rules, first a written warning, then taking the matter to the board's agenda, and if necessary, the legal path are followed.
