The Parking Lot Is Generally a Common Area

In apartments and complexes, the parking lot is a common area unless otherwise specified in the management plan. That is, unless a specific space belongs to a unit in the title deed (as an annex), it is under the common use of all owners. This means that the approach "I always park here, this is my space" has no legal basis in most cases.

Can Parking Spaces Be Allocated?

Allocation of specific spaces in the common parking lot to specific units is possible, but this is done by a decision of the board of unit owners. The board may establish a fair allocation system (numbered spaces, order, lottery, etc.). A single owner's unilateral claim on a space is not valid; the allocation must be based on a common decision.
