How is a rent increase calculated?

Under Article 344 of the Turkish Code of Obligations, in the renewed lease period the increase rate cannot exceed the TÜFE 12-month average. This is the rate announced by TÜİK in the month the contract is renewed.

Important: not monthly or annual inflation, but the 12-month average is the basis. Even if a higher rate is stated in the contract, it is invalid.

Increase amount = Current rent × (Rate ÷ 100)
New rent = Current rent + Increase amount

15,000 × 30 ÷ 100 = 4,500 ₺ increase → 15,000 + 4,500 = 19,500 ₺ new rent.

Frequently asked questions

Does the 25% rent increase cap still exist?
No. The 25% cap introduced on residential rents on June 11, 2022 ended on July 1, 2024. Since that date, the sole legal limit is the TÜFE 12-month average.
Are residential and workplace calculated differently?
No. Since July 1, 2020, the upper limit for both residential and roofed workplace leases is the TÜFE 12-month average; the calculation is the same.
Which month's TÜFE rate should I use?
Use the 12-month average announced by TÜİK in the month your contract is renewed. The rate changes monthly and is announced around the 3rd of each month.
Can the landlord demand an increase above TÜFE?
No. TBK Art. 344 is a mandatory provision; an increase exceeding the TÜFE 12-month average is invalid. (In lease relationships exceeding 5 years, the court may decide differently based on precedent value.)
