How is the dues increase calculated?

Residential complex dues are determined by owners' assembly decision (KMK Art. 42). Under the annual operating plan, expenses are estimated and distributed per unit; this constitutes the new period dues.

This tool offers two modes: Percentage mode increases the current dues by the given rate; Amount mode uses the new dues directly. In both modes, the per-unit difference, site-wide monthly additional collection, and annual additional income are calculated.

Frequently asked questions

Is there a legal upper limit for dues increases?
Residential complex dues are not directly tied to TÜFE or any other index. The dues amount is determined by the owners' assembly decision pursuant to KMK Art. 42. The assembly votes on expenses and dues when approving the annual operating plan; no upper limit is set by law.
Should the dues be the same for every unit?
Under KMK Art. 20, expenses are generally distributed by land share; however, owners may agree on equal distribution by unanimity or through the management plan. This tool works assuming equal dues; use the "Dues Schedule Generator" tool for different dues based on land share.
Can the manager increase dues without an owners' assembly decision?
No. Dues increases fall within the scope of the operating plan; under KMK Art. 37, even if the manager prepares the operating plan alone, it is not finalized without assembly approval. An owner may refuse to pay an increase made without a decision.
Can retroactive dues differences be claimed?
General rule: a dues increase is valid from the decision date. However, if the operating plan pertains to the beginning of the year but was approved late, the assembly may also decide that it applies retroactively to the start of the year; in that case, the difference may be claimed.
