How is dues late-payment interest calculated?
It is commonly called "late-payment interest," but the correct legal term is late-payment penalty. Condominium Law Art. 20 provides for a 5% monthly penalty for a unit owner who fails to pay their share of expenses and advances (dues) on time, for the days of delay.
This rate is not absolute: the management plan or the unit owners' assembly may set a different one. If they don't, the statutory 5% applies.
Daily compensation = (Amount × Rate ÷ 100) ÷ 30
Compensation = Daily compensation × Days overdue
Total debt = Amount + Compensation
Example
1,500 × 5 ÷ 100 = 75 ₺/month → 75 ÷ 30 = 2.50 ₺/day → 2.50 × 45 = 112.50 ₺ compensation.
